Article 1. Concepts and applicability
1.1 On all offers, orders and agreements of Mom in Balance B.V. (hereafter: shopmominbalance.com), these General Terms of Sale (hereafter: Terms and Conditions) apply. Unless shop.mominbalance.com agrees in writing with other terms and conditions. Any agreed abnormalities may not entitle the customer to future transactions.
1.2 Accepting an offer or making an order means that you accept the applicability of these terms.
1.3 The provisions of these Terms and Conditions may be waived only in writing, in which case the remaining provisions will remain in force.
Article 2. Offers / Agreements
2.1 All offers from shop.mominbalance.com are free of obligation and shop.mominbalance.com reserves the right to change the prices, especially when required by (legal) regulations.
2.2 An agreement will only be made after acceptance of your order at shop.mominbalance.com. shop.mominbalance.com is entitled to refuse orders or to place certain terms on delivery unless expressly stated otherwise. If an order is not accepted, shop.mominbalance.com will inform you within two (2) business days of receipt of the order.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in euro inclusive of VAT.
3.2 For transport including insurance within the Netherlands we charge a fixed amount for orders of less than € 75. For orders over € 75, we will not charge shipping. For customers from countries other than the Netherlands, the contribution to shipping costs depends on the country and the weight of your order. The charged shipping costs are for small packages. If the shipping costs for your order are higher than you are being charged for, shop.mominbalance.com has the right to sent an extra invoice to the buyer before shipping. If you do not agree to pay the extra shipping costs shop.mominbalance.com has the right to cancel the order and will return the paid amount directly to your bank account within 3 working days.
3.3 After ordering, you will receive a confirmation by email, including the total costs and shipping costs. The payments of shop.mominbalance.com are provided by MultiSafePay. You can use iDEAL, SOFORT Banking, Maestro, MasterCard, VISA, American Express, Bancontact. No additional charges are charged for these online payments. Please be aware that shipment is done from the Netherlands.
Article 4. Delivery
4.1 We ship all orders that are made on working days before 5 pm (CET) and after receiving the payment via our courier service Frama on the same day to the indicated delivery address. If we deviate from this for particular reasons, you will receive a message via email. However, in principle, an order will always be sent within 4 working days after receipt of the payment. We send all packages through Frama.
4.2 Exceeding the agreed delivery time does not entitle the customer to reimbursement, termination of the agreement or non-compliance with any obligation which may result from him or her from any other related agreement.
4.3 The product must be delivered to the customer within 30 days of ordering. If this does not happen, the customer can undo the purchase. This does not apply if the parties have agreed on a different delivery period.
4.4 Delivery in parts is allowed.
4.5 We do our best to keep the website as up-to-date as possible, however, it could happen that a product is no longer available. In this case, we will contact you as soon as possible.
Article 5. Return shipment
5.1 We make every effort to deliver a perfect product. If, however, the ordered item does not meet your expectations, you can return them within 7 calendar days of receipt of the order at your own expense, to the following address: Mom in Balance, Wagenweg 146, 2012 NK Haarlem, The Netherlands.
5.2 We will solve any problem as soon as possible. If the solution does not meet your expectations, you can cancel the order without additional costs. The amount already paid will be refunded within 3 working days after the order has been returned. This warranty expires when: a. the product is worn and/or washed; b. you have tried to repair a defect, c. the product instructions are not followed.
5.3 If you do not wish to withdraw a product for any reason, you have the right to return the product within 14 calendar days. Returns, in this case, will only be accepted if the packaging of the product is undamaged, the product is not worn and/or washed and is labelled with all labels. The cost of returning is for your own account. Mom in Balance will return the paid amount directly to your bank account within 3 working days after a product has been returned in good condition.
Article 6. Liability
6.1 shop.mominbalance.com accepts no liability for any damages resulting from the use of the products of shop.mominbalance.com.
6.2 Any liability of shop.mominbalance.com to the buyer is, in any event, limited to the amount of the invoice that the buyer owes to the shop.mominbalance.nl pursuant to the agreement in question.
Article 7. Privacy
All personal data is used solely for the handling of the order and will never be made available to third parties.
Article 8. Applicable law and competent court
8.1 All Dutch law applies to all rights, obligations, offers, orders and agreements to which these terms and conditions apply.
8.2 All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
These General Terms of Sale of shop.mominbalance.com are deposited in the Handelsregister in Haarlem, under KvK-number 60322799.
